Referral Fees Paid to Referring Lawyers Pursuant to Fla. Bar Ethical Rules

From time to time, Joel Ewusiak is fortunate to receive referrals of cases from lawyers located in Florida and other parts of the country. In recognition of the value and service provided by referring lawyers to their clients, Joel considers the payment of referral fees on contingency fee cases in strict compliance with all Florida Bar ethical rules, which includes the client's signed authorization and consent to any fee sharing. (In Florida, the payment of referral fees to lawyers is governed by Rule 4-1.5 Fees and Costs for Legal Services of the Rules of Professional Conduct, which is available for review here.)

The percentage of the referral fee paid to the referring lawyer is based on the unique circumstances of each case. As part of his goal to pay a fair percentage to the referring lawyer, Joel considers a variety of factors, such as the nature of the case, the level of risk, the anticipated litigation costs, and the extent to which the referring lawyer is involved in the case. At the conclusion of a contingency fee matter, the referral fee is promptly paid to the referring lawyer.
